Who we are
GoatedLeads is an Australian pay per lead service. In these terms, we, us and our mean GoatedLeads. You means the advisory firm buying leads from us.
These terms apply to every lead we deliver. You accept them when you agree a price per lead with us in writing.
What a lead is
A lead is an enquiry from a person in Australia who has said they want to buy an investment property and has asked to be contacted by an adviser. Before we send it, we check that the mobile number is a working Australian number, that the person's stated location and budget fit the markets and price range we agreed with you, and that we have not already sent that person to you.
A lead arrives by SMS and email with the person's name, mobile, email, stated budget range, stated deposit or equity position, timeframe and location interest. What they say about their finances is what they told us. We do not verify it.
A lead is a request for a conversation. It is not a booked consultation, a client, or a promise that the person will proceed with anything.
Price
We agree one price per lead with you in writing before a campaign runs. That price stays fixed while the campaign runs. It changes only when both of us agree to a new price in writing.
Prices are stated exclusive of GST unless the written agreement says otherwise.
Billing
We bill weekly in arrears for the leads delivered in that week, at the agreed price. Payment terms are on the invoice.
If an invoice is overdue we may pause delivery until it is paid. Leads delivered before the pause remain payable.
Exclusivity
Every lead goes to one advisory firm, the one it is delivered to. We do not send the same enquiry to anyone else, and we do not resell it later.
We may run campaigns for other firms in the same markets. No single enquiry is shared between them.
Replacement or credit
We replace or credit a lead when the mobile number is wrong or disconnected, when the person's location is outside the markets we agreed, when the enquiry is not for what we agreed to send (for example a person asking for something other than help buying an investment property), or when it duplicates a lead we already sent you.
To claim, flag the lead within five business days of delivery and tell us which of those reasons applies. We check it against our records and reply in writing. A replacement is a further lead at no charge. A credit comes off the next invoice.
We do not replace or credit a lead because the person did not answer, changed their mind, went with someone else, was outside a budget you did not tell us about, or did not proceed.
No guarantee
We do not guarantee how many leads you will receive in any period. Volume depends on advertising demand, the markets you chose and the price agreed.
We do not guarantee that any lead becomes a consultation or a client. How fast you call, and what you say when you do, is up to you.
We are not an adviser
GoatedLeads is not a financial adviser, credit provider, real estate agent or property adviser. We make no representation about any property, any investment, or the suitability of any investor for your services. Everything said to an investor after delivery is said by you, in your name, under your licence.
Stopping
Either of us can stop at any time by notice in writing. Email counts. We stop advertising for you when your notice arrives. Enquiries already in progress may still arrive for a short time after that, and every lead delivered before we stop remains payable at the agreed price.
Acceptable use
You must hold every licence, registration or authorisation your business needs to do what you do: for example a real estate licence where your firm also acts as a buyers agent, and an Australian financial services licence or authorised representative status where the advice you give requires one. You are responsible for staying licensed and for complying with the law that applies to your advice.
You must contact an investor only about the enquiry they made. You must stop contacting an investor when they ask you to. You must not sell, share, lend or pass on a lead to anyone outside your business. You must handle each investor's personal information lawfully and in line with our privacy policy.
If you break these rules we may stop delivery at once, and any leads delivered remain payable.
Liability
Our liability to you for any lead is limited to the fees you paid us for that lead. We are not liable for lost profit, lost clients or any indirect loss.
Nothing in these terms excludes any right you have under the Australian Consumer Law that cannot be excluded. Where the law lets us limit our liability for breach of a consumer guarantee, it is limited to supplying the service again or paying the cost of having it supplied again.
Changes to these terms
We may update these terms. The current version is on this page with the date at the top. Continuing to take leads after a change means you accept the changed terms. The price per lead only ever changes by written agreement.
Governing law
These terms are governed by Australian law and the law of the state in which GoatedLeads is registered. Any dispute goes to the courts of that state.
